Application for Relief from Rates on the Grounds of Hardship

Section 49 of the Local Government Finance Act 1988 provides that a Charging Authority may reduce or fully remit an amount of Non Domestic Rates, provided it is satisfied that:

  1. The ratepayer would sustain hardship if the authority did not do so, and
  2. It is reasonable for the authority to do so, having regard to the interests of the persons subject to its Council Tax

Please note that this is a discretionary relief and as such there is no right of appeal if the authority refuses to grant the relief or awards a lower percentage than you are asking for. Each case will be assessed individually it is therefore important that you provide as much information and evidence as possible.
